Any reference to “you” or “the client” means the person or organisation booking the work.

These terms should be read carefully before confirming a booking. They cover the booking process, payment arrangements, cancellations, liability limits, waste handling, and the law that applies to the agreement. We accept payment by the methods specified at the time of booking. Late payments may result in the suspension of further services, administration charges, or recovery action where appropriate. Any unpaid amount remains due until settled in full. The client is responsible for ensuring that payment is made by the correct person or organisation and that invoice details are accurate before work starts. 4. Cancellations, postponements, and rescheduling

The client may cancel or reschedule a booking by giving reasonable notice. If notice is provided within the period specified on the quote or booking confirmation, we may offer a new date without charge. If cancellation occurs after staff, equipment, or materials have already been allocated, we reserve the right to charge for costs reasonably incurred. For larger or bespoke garden projects, a longer cancellation period may apply because the work may have been specifically planned around the booking.

If we need to cancel or postpone a visit because of unsafe weather, operational issues, equipment failure, illness, or any matter outside our control, we will notify the client as soon as reasonably possible and arrange an alternative appointment. We are not liable for any indirect loss arising solely from a rescheduled date, provided we act reasonably and in good faith. The client understands that outdoor work is sometimes weather-dependent and that timings may need to remain flexible.

5. Liability and customer responsibilities

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law. Subject to that, our liability for loss or damage arising from the service is limited to the amount paid or payable for the specific work giving rise to the claim, except where a higher limit is agreed in writing. We will not be liable for loss of profit, loss of enjoyment, indirect loss, or consequential damage.

The client is responsible for removing or securing valuables, fragile items, ornaments, toys, equipment, and any other property that could be damaged during the service. We may move lightweight items where necessary to complete the work, but we are not obliged to handle delicate or expensive items unless specifically agreed. 6. Waste removal and regulations

Garden waste created during the service may be removed, stored, or left on site depending on the agreement made at booking. We aim to dispose of green waste responsibly and may separate recyclable material where practical. If specific disposal arrangements are required, the client must inform us in advance.

The client agrees not to ask us to dispose of waste unlawfully or to mix controlled waste with ordinary green waste. If the site contains large volumes of spoil, timber, rubble, or mixed debris, this may be treated as a separate service and priced accordingly. All waste-related work is carried out subject to legal compliance and safe working practice.

7. Access, delays, and interruptions

The client must ensure we can access the property at the agreed time and that any gates, driveways, shared entrances, permits, or security arrangements are in place. If access is restricted, delayed, or unavailable, we may charge for waiting time or a wasted visit where reasonable. We are not responsible for delays caused by traffic, weather, blocked access, or third-party interference, although we will always try to keep disruption to a minimum.

Where work is interrupted by unforeseen issues such as severe weather, unsafe conditions, buried obstacles, or equipment problems, we may suspend the service until it is safe to continue. Any unfinished work may be rescheduled at our discretion. If the interruption is due to a matter within the client’s control, we reserve the right to charge for time already spent and any costs that cannot be recovered. This applies equally to one-off jobs and ongoing garden maintenance services.

8. Complaints, corrections, and service concerns

If the client believes there is a problem with the service, they should notify us within a reasonable time after completion. We may ask for photographs, a description of the issue, and details of any relevant circumstances so that we can assess the concern properly. If an error has occurred and is attributable to us, we may choose to return and correct the issue, offer a partial refund, or agree another proportionate remedy.

Minor variations in appearance, growth response, seasonal colour, or pruning recovery do not necessarily amount to defective service, especially in outdoor environments where natural conditions change quickly. We do not guarantee plant survival, lawn recovery, or long-term results where matters beyond our control affect the garden. Any complaint will be reviewed fairly and in line with the information available at the time the work was completed.

9. Governing law

These Terms and Conditions, and any dispute or claim arising from them, are governed by the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction, unless mandatory law provides otherwise. If any provision in these terms is found to be unlawful, unenforceable, or invalid, the remaining provisions will continue in full force and effect.

By booking with Gardeners West Drayton, the client confirms that they have authority to enter into the agreement and that they accept these terms as the complete basis of the service relationship unless a written variation has been agreed. These terms may be updated from time to time, and the version in force at the time of booking will apply to the work being carried out.
